As a result of price increases by manufacturers, the minimum wholesale and retail prices for the sale of all brands of cigarettes in New York State have changed.

Chapter 203 of the Laws of 2009 extended the tax-related incentives for businesses to locate or relocate their offices and employees in lower Manhattan. The original incentives were provided by Chapter 2 of the Laws of 2005 (Tax Law section 1115(ee)). Included in the new legislation are amendments that extend exemptions from New York State and local sales and use taxes (sales tax) for certain purchases of tangible personal property and services related to leased commercial office space in certain eligible areas in lower Manhattan (i.e., Eligible Area A and Eligible Area B).
The public safety communications surcharge replaces the state wireless communications service surcharge. Therefore, TSB-M-02(5)M should not be relied upon for periods beginning on or after September 1, 2009.
The city of Yonkers has enacted legislation to extend the imposition of the Yonkers mortgage recording tax. The rate of this local tax is $.50 for each $100 of principal debt secured by a mortgage. The Yonkers tax is in addition to the state and Westchester County mortgage recording taxes. Therefore, the rate of mortgage recording taxes imposed on the recording of mortgages on real property located in Yonkers will continue to be $1.80 for each $100 of principal debt secured by a mortgage.
In Greene County, mortgages are currently subject to the basic and special additional mortgage recording taxes at the combined rate of $0.75 for each $100.00 secured by the mortgage. Effective October 1, 2009, Greene County has elected to impose a county mortgage recording tax of $.50 for each $100.00 secured by the mortgage. The county mortgage recording tax will apply to mortgages recorded on or after October 1, 2009. Therefore, as of October 1, 2009, the rate of mortgage recording taxes imposed on the recording of mortgages on real property located in Greene County will be $1.25 for each $100.00 secured by the mortgage.

New York State Department of Taxation and Finance Acting Commissioner Jamie Woodward announced today that Gary Mackiewicz, president and owner of D&M Refrigeration, Inc., located at 1340 William Street, Buffalo, pled guilty to stealing $231,555 in state sales tax by failing to report over $2.6 million in taxable income over a three year period.
