Empire State Development (ESD) is conducting a review of all existing Empire Zone (EZ) businesses.
- Businesses that meet requirements for continued certification will receive Empire Zone Retention Certificates beginning in early June.
- Businesses that don’t meet requirements for continued certification will receive notification from ESD that explains the appeal process.
Information on claiming corporate and personal income tax EZ credits
If ESD issues an Empire Zone Retention Certificate to your business after you already filed a return for a tax year beginning on or after January 1, 2008:
- Refile a copy of your complete original return with all attachments, and a copy of your retention certificate. We will begin processing these returns on July 30.
- If you are a partnership, LLC, or an S-Corporation provide a copy of the Empire Zone Retention Certificate to all partners, members, or shareholders. Your partners, members, or shareholders must attach a copy of the Empire Zone Retention Certificate to their tax returns.
If ESD notifies your business that it will not be receiving an Empire Zone Retention Certificate and you already filed a return claiming EZ credit(s) for a tax year beginning on or after January 1, 2008, we will:
- Process your return disallowing your EZ credit(s)
If you haven’t filed a return yet and you are claiming an EZ credit, be sure to attach a copy of your Empire Zone Retention Certificate. Beginning on July 30, the department will start processing all returns claiming EZ credit(s) and will disallow any EZ credit(s) on returns without an Empire Zone Retention Certificate attached.
